Abstract: 

Em busca de tornar mais eficiente a proteção ambiental, demonstrase a relevância do uso de novos arranjos jurídicos, como a flexibilização de conceitos e a ampliação dos identificadores de institutos tradicionais para atingir tal fim. Via correspondência entre os efeitos sancionadores do Dano Moral Coletivo-Ambiental e diretrizes do Estado de Direito Ambiental, intentase: relacionar meios propostos pelo modelo Estado de Direito Ambiental com instrumentos jurídicos presentes no Estado Democrático de Direito brasileiro; asseverar a importância da técnica de releitura de institutos clássicos, a exemplo do Dano Moral, para a defesa do meio ambiente; expor a divergência no STJ – menos intensa na atualidade – quanto ao reconhecimento do Dano Moral Coletivo-Ambiental, mediante análise das teses utilizadas no acórdão do Resp. 598.281, que inaugurou no Tribunal debate sobre o Dano Moral Coletivo-Ambiental resultante de ofensa ao meio ambiente.

English Abstract: 

In order to make environmental protection more efficient, it is demonstrated the relevance of the use of new legal arrangements, such as the flexibility of concepts and the extension of the identifiers of traditional institutes to achieve this end. Through correspondence between the sanctioning effects of the Environmental Collective Moral Damage and the guidelines of the State of Environmental Law, we try: to relate means proposed by the State Environmental Law model with legal instruments present in the Brazilian Democratic State of Law; to assert the importance of the technique of re-reading classic institutes, such as Moral Damage, for the defense of the environment; to expose the divergence in the STJ – less intense at present – regarding the recognition of the Collective Environmental Moral Damage, by analyzing the theses used in the Resp. judgment. 598.281, which opened in the Court's debate on the Collective Moral Damage resulting from offense to the environment.
