Abstract: Emergencies present significant challenges to legal systems committed to the rule of law. While providing considerable latitude for State action to respond as deemed necessary, the legal system nonetheless seeks to limit and render accountable (to some degree) the exercise of extraordinary powers in an attempt to minimise the risk of misuse or over-reaction.
