Title: | A discussion of the recent excision of Christmas Island from Australia's migration zone in the light of Australia's international refugee obligation of non-refoulement | Contributor(s): | Della-Torre, Emilia Ida (author) | Publication Date: | 2003 | Handle Link: | https://hdl.handle.net/1959.11/1528 | Abstract: | The Australian Government's 'Pacific Solution' which prohibits asylum seekers from entering Australia’s migration zone and applying for refugee status raises a number of legal issues. This article explores the extent to which the 'Pacific Solution' is consonant with Australia's international refugee obligation of non-refoulement. The international law of non-refoulement is detailed. It is then applied within the contemporary Australian context. This article concludes that the 'Pacific Solution' does not strictly violate Australia's obligation of non-refoulement towards asylum seekers. | Publication Type: | Journal Article | Source of Publication: | Australian Journal of Human Rights, 9(2), p. 123-137 | Publisher: | LexisNexis Butterworths | Place of Publication: | Australia | ISSN: | 1323-238X | Fields of Research (FoR) 2008: | 180114 Human Rights Law | Peer Reviewed: | Yes | HERDC Category Description: | C1 Refereed Article in a Scholarly Journal | Publisher/associated links: | http://www.austlii.edu.au/au/journals/AJHR/2003/20.html http://www.lexisnexis.com.au/aus/products/catalog/current_htm/AHR.asp |
