Abstract: Australia's biotechnology sector includes a transgenic animal industry. The fate of and fallout from this industry is a function of Australia's patent law. In this paper, the pivotal role of the patent in the growth of a transgenic animal industry in Australia is considered, the need to renovate Australian patent law in light of this industry discussed and a means for effecting this renovation proposed.
