Abstract: Australia is a federal system comprising the Commonwealth government, six State governments and two territory governments. Each State government has the right to enact maritime legislation relating to its internal waters and the first 3nm of the territorial sea. Each State has enacted environmental legislation regarding discharge and emissions in its area of authority. Commonwealth legislation has been formulated to comply with Australia's international obligations and to meet the needs of the Australian community.
