English Abstract: The free movement of capital is one of the fundamental freedoms of the European common market. Article 58 specifies the conditions and prerequisites for member states to maintain domestic legal provisions which otherwise qualify as an infringement of the free movement of capital. This is especially relevant in the area of taxation law. The chapter analyzes the scope and content of these exceptions.
