Abstract: The aim of this fifth edition of 'The Law of Torts in Australia', like that of the previous four, is to provide a distinctively Australian account of the most important parts of tort law, primarily for use by students.The first three editions were jointly authored by Peter Cane and Francis Trindade. For the fourth edition, Mark Lunney joined the team. This fifth edition marks the retirement of Francis Trindade from active involvement in the ongoing life of the book, although his contribution has left many indelible marks on the chapters for which he was primarily responsible in earlier editions. Without Francis's enthusiasm and dedication, patience and determination, this book would never have been born. Without his careful scholarship and rich legal imagination, it would not have achieved the success of such longevity. We heartily thank him for all his efforts over the years and wish him a very long and happy retirement. Peter Cane has particularly valued Francis's personal friendship and academic companionship since the summer afternoon in the early 1980s when a conversation on the High Street in Oxford (where Francis was on sabbatical leave and Peter was a young law tutor at Corpus Christi College) set them both on the arduous path of writing a tort text from scratch.
