Abstract
This is the second edition of a book that states the basic principles and provides the fundamental source material required for a study of New South Wales criminal law and procedure. The book remains unique for its strong focus on the jurisprudence of the New South Wales criminal courts; however, the principles explored in the book will assist in understanding the criminal law of all Australian jurisdictions. This edition examines the substantive law in a procedural and evidentiary context. The first edition was used and appreciated not only by law students, but also by practitioners and other concerned with the practical operation of the New South Wales criminal justice system. In the second, the authors have maintained their effort to meet the resource needs of practitioners and others working in the field. A special feature of the book continues to be the provision of elucidatory flowcharts, aimed at introducing the reader to the framework of general principle, before proceeding to an examination of the principles in detail. Examples and problems are also provided so the reader can examine how the principles might operate in practice.
